InkFoundry Studio End User Licence Agreement

This agreement is between you and ECB Studios ("we", "us"). By installing or using InkFoundry Studio (the "Software") you agree to it. If you don't agree, don't install or use the Software, and contact us within 14 days of purchase for a refund.

1. Your licence

When you buy a licence, we grant you a personal, non-exclusive, non-transferable right to install and use the Software on up to 2 computers that you own or control, for your own business or personal projects. The Software is licensed, not sold.

2. What you may not do

You may not: share, resell, rent or give away the Software or your licence key; remove or bypass licence checks; copy the Software except for installation and backup; or reverse-engineer, decompile or disassemble it, except where the law expressly allows this despite this restriction.

3. Your content belongs to you

Everything you create with the Software (research, images, books, PDFs, listings) is yours to use, including commercially, subject to Section 5 and the terms of the AI services you connect. We claim no ownership of your content and we never receive it.

4. Third-party AI services and your API keys

The Software connects to AI and data services that you choose (for example OpenAI, Anthropic, Replicate, ComfyUI, Ollama), using your own accounts and API keys. Those services are provided by their owners, not by us, under their own terms and prices. You are responsible for: your accounts with them, all charges they bill you, and following their terms and usage policies. We are not responsible for their availability, output, pricing changes, or account decisions.

5. AI output, marketplaces and your responsibilities

AI-generated content can be inaccurate, contain spelling mistakes, resemble existing works, or include names, phrases or designs protected by trademark or copyright. The Software's checks (for example its trademark warnings, resolution checks and marketplace limit checks) are aids only and are not complete. Before you publish or sell anything, you are responsible for:

• reviewing it for accuracy, quality and spelling;
• making sure it doesn't infringe anyone's trademark, copyright or other rights (for example by searching the USPTO or your local trademark database);
• following each marketplace's rules, including Amazon KDP's requirement to disclose AI-generated content and Etsy's policies;
• for books on health, legal, financial or safety topics, having the content checked by a qualified professional.

6. No guarantee of results

The Software helps you research and create products. We make no promise that you will make sales or earn any amount of money. Niche scores and research results are estimates, not sales data. Your results depend on many things outside our control.

7. Updates and support

We may provide updates. Support is provided by email at outlook.com">inkfoundrystudio@outlook.com on a reasonable-effort basis. Features that depend on third-party services may change or stop working if those services change.

8. Refunds

Refunds are handled according to the refund policy shown where you bought the Software (currently 14 days from purchase). Nothing in this agreement limits refund or consumer rights you have under the law where you live.

9. Warranty disclaimer

To the fullest extent the law allows, the Software is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't warrant that it will be error-free or uninterrupted, or that files it creates will be accepted by any marketplace.

10. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for lost profits, revenue, data or business, or for charges from third-party services, arising from your use of the Software. Our total liability for any claim is limited to the amount you paid for the Software. Some places don't allow these limits, so they may not fully apply to you.

11. Ending this agreement

This licence ends automatically if you break it. When it ends, you must stop using and uninstall the Software. Sections 3, 5, 6, 9, 10 and 13 continue after it ends.

12. Changes to this agreement

We may update this agreement for future versions. The version included with the release you installed applies to that release.

13. Governing law

This agreement is governed by the laws of the State of North Carolina, USA, except where the law of your country of residence gives you protections that can't be overridden.
